Terms of Service

1. Agreement to these terms

By accessing our website, installing an HBN Studio app, or using any related service (collectively, the “Services”), you agree to these Terms of Service. If you use a Service for a business or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree to these terms, do not install or use the Services. Shopify’s own terms also apply to your use of Shopify and are separate from these terms.

2. Scope of the Services

These terms apply to all Shopify apps, website features, and related services HBN Studio makes available, including Services released after the effective date. Features, eligibility, technical requirements, usage limits, and plan details may vary by Service and are described in the relevant Shopify App Store listing or within the Service.

A Service may include supplemental terms for features that require additional rules. Those supplemental terms form part of these terms and control only where they expressly differ for that Service.

3. Installation and account access

You must maintain a valid Shopify account and grant the permissions reasonably required for the Service you choose. You are responsible for activity under your store and authorized accounts, for keeping access credentials secure, and for promptly removing access from users who are no longer authorized.

Some functionality depends on Shopify APIs, themes, checkout behavior, app extensions, or third-party systems. Changes to those systems may affect a Service’s operation.

4. Plans, billing, and cancellation

Current plans, charges, trial periods, and included features are presented in the relevant Shopify App Store listing or Shopify billing approval screen. By approving a paid plan, you authorize Shopify to charge you under Shopify’s billing terms. Applicable taxes may be added.

You can cancel an app subscription by uninstalling the app or using another cancellation method made available through Shopify or the Service. Cancellation stops future recurring charges after the applicable billing period unless Shopify’s billing rules state otherwise. Charges already incurred are non-refundable except where required by law or expressly stated through Shopify.

5. Acceptable use

You must not use the Services to:

• violate law, regulations, third-party rights, or Shopify policies;
• send, display, or facilitate unlawful, deceptive, or harmful content;
• probe, disrupt, overload, or bypass security or access controls;
• introduce malware or use the Services for unauthorized surveillance;
• reverse engineer or copy a Service except where law expressly permits;
• resell, sublicense, or provide a Service to third parties without permission; or
• use automated means in a way that materially interferes with the Services.

We may investigate suspected misuse and suspend or limit access when reasonably necessary to protect merchants, customers, Shopify, HBN Studio, or the Services.

6. Your responsibilities

You are responsible for configuring and testing each Service before relying on it, reviewing its continued operation after store or theme changes, and ensuring that your use complies with applicable laws and your own commitments to customers. You retain responsibility for prices, discounts, messages, delivery estimates, product information, and other business decisions or content you configure.

You must have all rights, notices, consents, and lawful bases needed for information or content you direct a Service to process. The Services do not provide legal, tax, accounting, or other professional advice.

7. Your content and data

You retain ownership of content and data you submit to a Service. You grant HBN Studio a limited, non-exclusive right to host, copy, transmit, modify, and otherwise process that content only as needed to provide, secure, support, and improve the Services and comply with law.

8. HBN Studio property

HBN Studio and its licensors retain all rights in the Services, including software, designs, documentation, branding, and other materials, excluding your content and third-party materials. These terms give you a limited, revocable, non-transferable right to use the Services for your internal business purposes while you comply with these terms.

If you provide feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.

9. Shopify and third-party services

The Services may interoperate with Shopify or link to third-party products and websites. HBN Studio does not control those services and is not responsible for their availability, content, security, or practices. Your use of them is governed by their own terms.

10. Changes and availability

We may add, modify, or discontinue features and may update technical requirements to maintain security, compatibility, or service quality. We will provide notice when reasonably practicable if a material change significantly reduces core paid functionality.

We aim to keep the Services reliable, but we do not promise that they will always be uninterrupted, error-free, or compatible with every store configuration or future platform change.

11. Suspension and termination

You may stop using a Service at any time. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay applicable charges, or if Shopify restricts the Service’s platform access. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue.

Provisions that by their nature should continue—such as ownership, disclaimers, liability limitations, and accrued payment obligations—survive termination.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” HBN Studio disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not guarantee specific sales, conversion, ranking, compliance, or other business results.

Nothing in these terms excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, HBN Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data, arising from or related to the Services.

To the fullest extent permitted by law, HBN Studio’s total liability for all claims relating to a Service will not exceed the greater of the amount you paid for that Service during the six months before the event giving rise to the claim or USD $100. These limits do not apply where liability cannot lawfully be limited.

14. General terms

If any provision is unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will stay in effect. A failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a reorganization or transfer of the Services.

These terms, any applicable supplemental terms, and the Privacy Policy are the entire agreement between you and HBN Studio concerning the Services and supersede prior discussions about them.

15. Updates to these terms

We may update these terms to reflect changes to the Services, law, or our business. We will post the revised terms here and update the effective date. If a change is material, we may provide additional notice through the relevant Service or Shopify. Continued use after the updated terms take effect constitutes acceptance where permitted by law.
